Terms of Service Privacy Policy Security Acceptable Use Policy Community Guidelines

These Terms of Service ("Terms") are a binding agreement between you and JEFFERSON TEIXEIRA DA SILVA LTDA, a Brazilian company registered under CNPJ 49.180.596/0001-48 and trading as Behind Solutions TI, operating as NativeBlade ("NativeBlade", "we", "us"). They govern your use of the NativeBlade Website and Services.

Please read them together with our Privacy Policy, Acceptable Use Policy and Community Guidelines, which are part of these Terms.

1. Definitions

  • Website means nativeblade.dev and its subdomains, including app.nativeblade.dev, docs.nativeblade.dev and mcp.nativeblade.dev.
  • Services means everything we make available to you through the Website, the NativeBlade Cloud portal, our API, command line and Studio integrations, the hosted MCP server and the NativeBlade mobile app. This includes cloud builds, code signing, store submission, build artifacts, webhooks and notifications.
  • Framework means the NativeBlade open-source software published under the MIT License. The Framework is governed by its license, not by these Terms. You can use it without ever creating an account.
  • Your Content means anything you or your team provide to the Services: repositories and source code, build configuration, environment variables, signing credentials, certificates, keystores, configuration files, uploads, build logs and the artifacts produced from them.

2. Accepting these Terms

By creating an account or using the Services, you confirm that you have read and accept these Terms. If you use the Services on behalf of a company or other organization, you confirm that you are authorized to accept these Terms for it, and "you" refers to that organization.

If you do not agree with these Terms, do not use the Services.

3. Accounts

  • You must be at least 18 years old, or the age of legal capacity where you live if that is higher.
  • You must provide a valid email address and keep your account information accurate.
  • Each login belongs to one person. Do not share your password or authentication codes. To work with others, invite them to your team.
  • Accounts must be created by a person. Automated access to an existing account is allowed only through the tools we provide for it, such as API tokens and device authorization for the CLI and Studio.
  • You may hold only one Free plan account. Creating additional accounts to obtain more free builds is not allowed.
  • You are responsible for all activity under your account and for keeping it secure. We strongly recommend enabling two-factor authentication.
  • Team owners are responsible for the members they invite and the access they grant.

Tell us right away at security@nativeblade.dev if you believe your account has been accessed without your permission.

4. Using the Services

While your account is in good standing, we grant you a limited, non-exclusive, non-transferable and revocable right to use the Services to build, sign, test and distribute apps that you own or that you are authorized to build, including apps for your clients.

You may not:

  • resell, rent, sublicense or offer the Services themselves to third parties, or use them to operate a competing build service;
  • reverse engineer, decompile or attempt to extract the source code of the NativeBlade Cloud platform (this does not restrict anything the MIT License allows for the Framework);
  • bypass or attempt to bypass plan limits, build quotas, queue priority, rate limits or any security measure;
  • use the Services to build or distribute malware, spyware, crypto-mining software, or apps that violate the policies of the stores you publish to;
  • place an unreasonable load on our infrastructure, or interfere with other customers' builds;
  • use the Services in violation of any applicable law.

5. Beta and preview features

Some features are marked as beta, preview or early access, such as NativeBlade Studio and the hosted MCP server. They are provided "as is" for evaluation, may change or be discontinued at any time, and are not covered by any availability commitment.

6. Third-party services

The Services work with platforms we do not control, including GitHub, Apple (App Store Connect and TestFlight), Google Play and Stripe. Your use of those platforms is governed by their own terms. You are responsible for your developer accounts with them and for complying with their policies.

We do not guarantee that Apple, Google or any other store will accept, publish or keep your app available.

7. Your Content

You keep ownership of Your Content. You grant us a limited, worldwide, non-exclusive, royalty-free license to access, copy, process, store and transmit Your Content only as needed to provide the Services to you. For example: cloning your repository to run a build, using your signing credentials to sign it, storing the resulting artifacts, and submitting a build to a store when you ask us to.

You confirm that you have all rights needed to give us Your Content and to let us use it this way.

  • Secrets. Signing credentials, private keys, environment variables and service configuration files are encrypted at rest. See our Security page.
  • Store submissions. When we submit a build to a store, we do it on your instruction and on your behalf. You remain the publisher of your app.
  • Retention. Builds, build logs and artifacts are deleted automatically after the retention period of your plan, currently 7 days. Download anything you need to keep.
  • Personal data in Your Content. If Your Content includes personal data, you are the controller of that data and we act as your processor (the "operador" under the Brazilian General Data Protection Law, LGPD), processing it only to provide the Services and following your instructions as expressed through your use of the Services.

We may remove Your Content or restrict access to it if we reasonably believe it violates these Terms or the law.

8. Reporting infringing content

If you believe something hosted or distributed through the Services infringes your rights, email legal@nativeblade.dev with:

  • your name and contact details;
  • the work or right you believe is being infringed;
  • where the infringing material is, with enough detail for us to find it;
  • a statement that you believe in good faith the use is not authorized, and that the information in your notice is accurate.

We review every notice and may remove the material and notify the user who provided it. We will suspend accounts that repeatedly infringe the rights of others.

9. Our intellectual property

The NativeBlade Cloud platform, the Website, and the NativeBlade name and logo belong to us or our licensors. These Terms do not transfer any of those rights to you, except for the right to use the Services described above. The Framework remains available under the MIT License.

Feedback. If you send us suggestions or ideas, you allow us to use them to improve NativeBlade without any obligation to you.

Showcase. We will only list your app or company as a NativeBlade customer with your permission.

10. Plans and payment

Free plan. We offer a Free plan with the limits shown on our Pricing page. We may change those limits or discontinue the Free plan, and we will give reasonable advance notice when we do.

Paid plans. Paid plans are billed monthly, in advance, in US dollars, through our payment processor Stripe. Taxes may apply. We do not receive or store your full card number.

Additional builds. On plans that allow it, builds beyond your monthly allowance are charged per build and billed at the end of the billing period.

Upgrades. When you upgrade, the new plan starts immediately and you are charged for it at that time.

Cancellation and downgrades. You can cancel at any time in your billing settings. Your plan stays active until the end of the period you already paid for and then moves to the Free plan. To move to a lower paid plan, cancel your current plan first.

Refunds. Payments are not refunded for partially used periods, except:

  • Right of withdrawal. If you are a consumer, you may cancel within 7 days of your first payment for a plan and receive a full refund of that payment, as provided by article 49 of the Brazilian Consumer Defense Code.
  • Billing errors. If we charged you by mistake, we will refund the incorrect amount.

To request a refund, email billing@nativeblade.dev from the email address on your account. We aim to reply within 5 business days.

Price changes. We will notify you at least 30 days before a price change applies to your subscription. If you do not agree, you can cancel before the change takes effect.

Failed payments and chargebacks. If a payment fails or remains unpaid, we may limit your account to the Free plan or suspend it until the balance is paid. If you open a chargeback, we may suspend the account while the dispute is reviewed. Please contact us first; most billing issues are quick to fix.

11. Availability

We work to keep the Services available and builds moving, but we do not guarantee uninterrupted service, specific build times or queue positions unless we have agreed to a service level in a separate written contract, such as an Enterprise agreement.

We may perform maintenance, and we may change, add or remove features. If we remove a paid feature you actively use, we will tell you in advance.

12. Disclaimers and liability

To the extent permitted by law, the Services are provided "as is" and "as available". We do not guarantee that they will be error-free, that every build will succeed, or that your app will be approved by any store.

To the extent permitted by law, we are not liable for indirect or consequential damages, such as lost profits, lost revenue or lost data, and our total liability for any claim related to the Services is limited to the amount you paid us in the 12 months before the event that gave rise to the claim.

Nothing in these Terms limits rights that cannot be limited by law, including your rights as a consumer under the Brazilian Consumer Defense Code (Law 8,078/1990), or liability for fraud or willful misconduct.

You agree to indemnify us for losses caused by your breach of these Terms, by Your Content, or by your violation of the rights of others.

13. Suspension and termination

You can stop using the Services and cancel your plan at any time. To delete your account, see our Privacy Policy.

We may suspend or terminate your account if you seriously or repeatedly breach these Terms, if required by law, or if your use puts the Services, other customers or third parties at risk. When possible and appropriate, we will notify you first and give you a chance to fix the problem.

After termination, we delete Your Content and account data as described in our Privacy Policy, except where we must keep it by law. If your account is terminated for a reason other than a breach of these Terms or unlawful conduct, we will help you export your data on request.

14. Changes to these Terms

We may update these Terms. If a change materially affects your rights or obligations, we will notify you by email or in the Services at least 30 days before it takes effect. If you continue using the Services after that date, you accept the updated Terms. If you do not agree, you may cancel before the change takes effect.

15. Communications

We will send you emails about your account, builds, billing, security and changes to these Terms. These are part of the Services. Product news and tips are optional, and you can turn them off in your notification settings.

16. General

  • Entire agreement. These Terms and the policies they reference are the entire agreement between you and us about the Services, unless you have a separate written agreement with us.
  • Severability. If any part of these Terms is found invalid, the rest stays in effect.
  • No waiver. If we do not enforce a provision right away, we have not given up the right to enforce it later.
  • Assignment. You may not transfer these Terms without our consent. We may transfer them as part of a merger, acquisition or sale of assets, and we will notify you.
  • Force majeure. Neither party is liable for delays caused by events beyond its reasonable control.
  • Language. These Terms are written in English. If we provide a translation, the English version prevails, except where the law requires otherwise.

17. Governing law and jurisdiction

These Terms are governed by the laws of the Federative Republic of Brazil.

Disputes will be resolved in the courts of the city of Rio de Janeiro, State of Rio de Janeiro. If you are a consumer, you may bring a claim in the courts where you live, as guaranteed by the Brazilian Consumer Defense Code. Before going to court, we invite you to contact us at legal@nativeblade.dev so we can try to resolve the issue together.
